Terms of Use

These terms apply to the use of the TipsyTales app. They are also available in German: AGB. In case of discrepancies, the German version prevails.

1. Provider and scope

1.1 The provider is Britz & Weiland GbR, Nachtigallenstraße 26, 56751 Polch, Germany (see Legal notice). These terms apply to the TipsyTales Android app and web app including content, packs, bundle and premium subscription.
1.2 The app is intended exclusively for people aged 18 and over. By using it you confirm that you are at least 18.
1.3 Conflicting terms of the user do not apply. The terms of the respective store operator (Google Play) apply additionally.

2. Contract formation, account

2.1 A free-of-charge usage contract for the basic features is concluded when you first start the app. These terms can be accessed at any time in the app settings and on our website.
2.2 The basic features can be used without an account. An account (sign-in with Google or Apple) is optional and required for purchases. You must provide truthful information.
2.3 The app is intended for private use only.

3. Services

3.1 TipsyTales offers party and drinking-game modes with card content in German, English, French, Spanish and Polish, mini games, an alcohol-free mode, streaks, coins and a wheel of fortune. Further packs and a premium subscription are paid.
3.2 We may develop, change or remove features and content where this is reasonable for you, in particular for legal or technical reasons. Content you have already purchased remains usable to the extent described at the time of purchase.
3.3 We provide updates required for the app to remain in conformity (Section 327f German Civil Code). Continued use may require installing an update.
3.4 Online features (loading content, account, shop, sync) require an internet connection. We do not owe uninterrupted availability.

4. Coins and unlocks

Coins are earned exclusively by playing (rounds, streaks, wheel of fortune). They cannot be bought, transferred or paid out, have no monetary value and only unlock cosmetic extras that do not affect gameplay. The wheel of fortune requires no stake. Coins and unlocks expire when the account is deleted.

5. Prices, payment, subscriptions

5.1 Prices are shown in the app or store including VAT and in the local currency. Payment is made through the store operator (Google Play), in the web app through RevenueCat Web Billing.
5.2 Individual packs are one-time purchases. The bundle unlocks all packs available at the time of purchase unless the product description says otherwise.
5.3 The premium subscription runs monthly or yearly. Where shown, the first month is free; afterwards the displayed price is due. The subscription renews automatically unless cancelled before the end of the term.
5.4 You can cancel the subscription at any time effective at the end of the current term: in the app under Settings → Manage subscription or directly in the store. Deleting the app or the account does not cancel the subscription.
5.5 We announce price changes for running subscriptions with reasonable notice; they only apply with your consent or consent via the store.

6. Right of withdrawal

Withdrawal information for consumers
You have the right to withdraw from this contract within fourteen days without giving any reason. The withdrawal period is fourteen days from the day of conclusion of the contract. To exercise your right of withdrawal you must inform us (Britz & Weiland GbR, Nachtigallenstraße 26, 56751 Polch, Germany, email Kontakt@TipsyTales.de) of your decision to withdraw by an unequivocal statement (e.g. by email). It is sufficient to send the communication before the withdrawal period expires.

Effects of withdrawal: If you withdraw, we will reimburse all payments without undue delay and no later than fourteen days from receipt of your notice, using the same means of payment you used for the original transaction. If you requested that the service (e.g. the subscription) begin during the withdrawal period, you pay us an appropriate amount proportionate to what has been provided until you withdrew.

Early expiry: For contracts for digital content not supplied on a tangible medium (e.g. individual packs), the right of withdrawal expires once we have begun performance after you expressly consented to performance before the withdrawal period ends and acknowledged that you thereby lose your right of withdrawal (Section 356(5) German Civil Code). Refunds through the store are also governed by the store’s rules.

7. Liability

7.1 We are liable without limitation for intent and gross negligence, for injury to life, body or health, under the Product Liability Act, and where we have given a guarantee or fraudulently concealed a defect.
7.2 For slightly negligent breach of essential contractual obligations (obligations that shape the contract and on which you may regularly rely), our liability is limited to the foreseeable, typical damage. Otherwise liability for slight negligence is excluded.
7.3 Statutory rights in case of defects of digital products (Sections 327 et seq. German Civil Code) remain unaffected.

8. Responsible use

8.1 TipsyTales contains adult content that may be suggestive or sexual in nature. The tasks are game ideas; nobody has to drink alcohol. There is a separate alcohol-free mode.
8.2 Drink responsibly, never before or while taking part in traffic, and not if it endangers your health. Each player decides for themselves what to do. Section 7 remains unaffected.

9. Rights of use and duties

9.1 You receive a simple, non-transferable right to use the app for private purposes. All content is protected by copyright; reproduction or commercial use is prohibited.
9.2 You may not decompile or reverse-engineer the app except where permitted by law (e.g. Section 69e Copyright Act), and may not use the app unlawfully.

10. Deleting the account, suspension

10.1 You can delete your account at any time in the app under Settings → Delete account or by email. Subscriptions must be cancelled separately (section 5.4). We treat your data in accordance with the Privacy Policy.
10.2 For good cause, in particular serious or repeated breaches of these terms, we may suspend the account or terminate the contract, as a rule after a prior warning.

11. Data protection

How we process personal data is described in the Privacy Policy. These terms do not include any consent to data processing.

12. Changes to these terms

We may change these terms with effect for the future if the legal situation, case law or technical circumstances change, or if we extend the scope of services to your advantage. We announce changes at least six weeks in advance in the app or by email. They are deemed accepted if you do not object within that period; we point this out specifically in the notice. If you object, the previous terms continue to apply, but we may terminate the contract. Changes that materially shift the balance between performance and consideration require your express consent.

13. Governing law, jurisdiction

13.1 German law applies, excluding the UN Convention on Contracts for the International Sale of Goods. For consumers habitually resident in another state, the mandatory consumer protection provisions of that state remain unaffected.
13.2 For consumers the statutory places of jurisdiction apply. For merchants, our registered seat is the place of jurisdiction.

14. Dispute resolution

We are neither willing nor obliged to participate in dispute resolution proceedings before a consumer arbitration board.

15. Severability

If a provision of these terms is invalid, the remaining provisions remain unaffected. The statutory provisions apply.
